Hydraulic Fracturing One Step Closer to Reality in Illinois

The Illinois Department of Natural Resources (IDNR) filed the first draft of proposed rules for hydraulic fracturing ("fracking") in November of 2013. Comments were accepted by the agency until January 3, 2014. Due to the large volume of comments received by the agency (over 31,000), the revised administrative rules were not filed with JCAR until Friday, August 29, 2014. The committee in charge of oversight has 77 days to respond. If the committee does not respond by November 14, 2014, the rule-making process could start all over again. A link to the proposed rules can be found here. We have been closely following the adoption of this law and the rule-making process. We are in the process of analyzing the comments, responses and corresponding changes that IDNR has published, and will have additional information in the near future.
