Presenting Oral Argument to the Illinois Supreme Court

On March 22, 2023, Heyl Royster's Ann Barron presented an oral argument before the Illinois Supreme Court in the case of Cleeton v. SIU Healthcare. The Heyl Royster team successfully challenged the plaintiff's motion to convert a medical provider from a respondent in discovery to a defendant. The circuit court found that the plaintiff had not met her burden of proving probable cause for conversion as set forth in 735 ILCS 5/2-402. The plaintiff appealed, and the Fourth District Appellate Court affirmed the denial of the motion to convert in Cleeton v. SIU Healthcare, 2022 IL App (4th) 210284. The Cleeton case presents the first time the Illinois Supreme Court has considered the Illinois respondents in a discovery statute. Now, we await the decision. Please follow us for more updates.
