Orsi and Denning Secure Summary Judgment for Illinois Hospital, Nurses, and Physicians

Heyl Royster attorneys Mike Orsi and Mike Denning recently secured summary judgment on behalf of a northern Illinois hospital, ten employed nurses, and two hospitalist physicians. Plaintiff suffered from peripheral vascular disease and underwent surgery to revascularize his lower leg. His lower extremity arteries had become occluded, and the patient was in danger of losing his leg. His surgeon performed the surgery at the defendant hospital but encountered an unavoidable bleeding consequence while attempting to obtain access during the revascularization. The surgeon had to abort the surgery and make a judgment call as to when to surgically intervene again while leaving enough time for the patient to recover from the first surgery. After 4+ days, the patient had altered mental status and was transferred to another hospital where he underwent multiple amputations of his leg. 

Plaintiff claimed that the nurses and hospitalists should have intervened when the surgeon's plan did not provide quicker surgical intervention. Orsi and Denning secured summary judgment immediately before the beginning of the 3-week jury trial, successfully arguing that the hospitalists and nurses could not be held legally responsible for knowing the standard of care for a surgeon, and thus realizing that the surgeon was, under the plaintiff's theory, deviating from it.

The team, based out of the firm's Rockford office, secured the result just a few weeks after obtaining a defense verdict in a separate complicated medical negligence jury trial.
