Monfort and Benfield Obtain Dismissal with Prejudice in Fertility Fraud Case

Renee Monfort and Mark Benfield recently obtained dismissal with prejudice in what was reported to be the first case filed pursuant to the Illinois Fertility Fraud statute enacted on January 1, 2024. The plaintiff's Complaint alleged claims under the Illinois Fertility Fraud Act, medical malpractice, lack of informed consent, breach of contract, fraud, battery, and negligent infliction of emotional distress. After months of contested briefing, Renee and Mark obtained dismissal with prejudice on all counts.
