Barron Secures Victory in Commercial Dispute Against Local Bank

Heyl Royster's Ann Barron recently achieved a significant victory by obtaining an affirmance of a summary judgment order entered in 2019 in a commercial dispute against a local bank. Jenkins v. First National Bank filed in 2013, raised a myriad of claims for fraudulent misrepresentation, conspiracy, violation of the Illinois Consumer Fraud Act, negligent supervision, and emotional distress and sought multi-millions in damages. Through diligent discovery, Ann and the Heyl Royster team obtained documents showing the plaintiff knew or suspected of his alleged injury at the latest in early 2008, such that the complaint was not filed within the statute of limitations. Despite the plaintiff's attempts to prevent the order from becoming final, including filing for personal bankruptcy, the Fifth District Appellate Court upheld the summary judgment, and the Illinois Supreme Court rejected the plaintiff's petition for leave to appeal.
