Roth and Nolan Secure Summary Judgment Victory for Client in Fourteenth Amendment Case

Heyl Royster's Andy Roth and Leah Nolan secured a significant victory for our client, with the court granting summary judgment in our favor. The claim alleged our client violated the plaintiff's Fourteenth Amendment rights by failing to provide them with access to "medical transportation," while supervising the plaintiff on conditional release pursuant to the Illinois Sexually Violent Persons Commitment Act. The court found that the defendant acted reasonably in responding to the plaintiff's needs and charting a course with respect to his care and that the defendant followed company directives that were considered and consistent with prevailing pandemic response approaches.
