Bayer, Buecker & Nolan Secure Victory in Defamation Case

Heyl Royster is proud to announce that our team-Karl Bayer, Laura Buecker, and Leah Nolan-has secured a victory in a defamation case with the Federal Court granting a Motion to Dismiss. Plaintiff alleged that Defendant, an out-of-state resident, targeted the forum state of Illinois with her social media posts, which Plaintiff alleged were about him. He sued for defamation, emotional distress, and more.

The teams' argument successfully highlighted that Defendant's social media posts could have been referring to anyone and that Defendant did nothing to target the forum state. Ultimately, the Court found Plaintiff had failed to demonstrate personal jurisdiction and had failed to state a claim. The case illustrates the ongoing balance between free speech and legal accountability in the digital age.
