Drinkwine and Benfield Secure Win in Fifth District

Chris Drinkwine and Mark Benfield successfully defended an appeal in Illinois’ Fifth District. The case involved allegations of medical malpractice involving a medical device. Summary judgment was entered in favor of the defendants in the trial court due to the plaintiff’s insufficient disclosure of expert opinions. On appeal, the Fifth District affirmed, reasoning in part that the plaintiff’s non-compliance with Rule 191 (affidavit requirements) proved “fatal” to the case. The case is Dillon v. Christie Clinic LLC, 2025 IL App (5th) 241211-U.
